To promote ethical practices, healthcare managers must understand the ethical challenges encountered by key stakeholders. To characterize ethical challenges in Veterans Administration (VA) facilities from the perspectives of managers, clinicians, patients, and ethics consultants. We conducted focus groups with patients (n = 32) and managers (n = 38); semi-structured interviews with managers (n = 31), clinicians (n = 55), and ethics committee chairpersons (n = 21). Data were analyzed using content analysis. Managers reported that the greatest ethical challenge was fairly (...) distributing resources across programs and services, whereas clinicians identified the effect of resource constraints on patient care. Ethics committee chairpersons identified end-of-life care as the greatest ethical challenge, whereas patients identified obtaining fair, respectful, and caring treatment. Perspectives on ethical challenges varied depending on the respondent's role. Understanding these differences can help managers take practical steps to address these challenges. This article addresses in the first place the use made by Emmanuel Levinas of the contrast between the Bible and Greece. The author attempts to place this contrast in the context of the historical division between Athens and Jerusalem, the Hellenic and the Hebraic, etc. It is argued that one of the main motivations for the presence of this contrast in Levinas s thought is his attempt to address Martin Heidegger's appeal to the relation between the Greeks and the Germans. However, the article claims that it remains the case that Levinas never entirely succeeds in integrating an adequate account of ethnic identities into his ethics of alterity. /// O presente artigo tem por objectivo principal proceder a um estudo do uso feito por Emmanuel Levinas do contraste entre a Bíblia e a Grécia. Trata-se, pois, de uma tentativa de colocar este contraste no contexto da divisão histórica entre Atenas e Jerusalém, entre o mundo helénico e o mundo hebraico, etc. O autor argumenta que uma das principais motivações para a presença deste contraste no pensamento de Levinas é a sua tentativa de responder à associação estabelecida por Martin Heidegger entre a Grécia e a Alemanha. Por outro lado, contudo, o artigo também reclama que Levinas não foi completamente bem sucedido na sua tentativa de integrar de forma adequada as identidades étnicas na sua ética da alteridade. O objetivo central neste artigo é o de explicar o que é testemunho e como ele produz conhecimento e justificação. Conforme essa concepção, o testemunho é uma importante e habitual fonte de conhecimento e de justificação, bem como um conceito relevante em epistemologia social, comunicação e psicologia da aquisição de crença. Apesar de o testemunho, nessa concepção, não ser considerado uma fonte básica de conhecimento e justificação, é alegado que ele é uma fonte de conhecimento básico pois crenças básicas (...) não precisariam derivar de uma fonte básica. Assim, novas crenças podem ser geradas a partir do testemunho, mas novo conhecimento não pode ser produzido a não ser a partir de conhecimento anterior. Apesar disso, a posição defendida neste artigo considera que, mesmo que a justificação com base no testemunho seja, em última instância, dependente de outras fontes de justificação, o testemunho constitui uma fonte essencial tanto de conhecimento como de justificação. Em Anarquia, Estado e Utopia, Robert Nozick defende um Estado mínimo ao qual não deve ser dado o direito de redistribuir a propriedade que já foi distribuída pelos individuos. Nozick se apoia na ideia de estado de natureza tal como Locke propôs no Segundo Tratado Sobre o Governo, aproveitando, inclusive, a maneira de Locke fundamentar a propriedade privada. Locke explicou o direito natural à propriedade por meio do trabalho para superar uma crítica que Robert Filmer havia dirigido a (...) Hugo Grotius anos antes. Grotuis considerava haver, originalmente, um direito comum à posse dos bens e defendia que a propriedade privada surgiu a partir de um contrato entre os indivíduos. Filmer colocou em dúvida que um contrato para dividir a propriedade pudesse ter sido firmado entre todos ao mesmo tempo. Locke também defendia a propriedade privada a partir da propriedade comum, mas precisava superar a objeção que Filmer havia dirigido a Grotius. Nesse sentido surge a ideia de trabalho como fundamentador da propriedade privada, pois é o trabalho que a legitima em vez do contrato. Nozick, apesar de uma longa análise sobre a teoria da aquisição de Locke, em que discorre, inclusive, sobre o papel do trabalho no surgimento da propriedade privada, afirma que Locke pensava os bens naturais originalmente sem dono, quando, na verdade, para Locke eles eram propriedade comum a todos. O propósito do presente texto é elencar e avaliar algumas possíveis consequências desse pequeno equívoco interpretativo. (shrink)

La sua acuta riflessione sa pro-vocare e destare l'uomo di oggi alla 'grande questione' ch'egli da sempre è a se stesso, ponendolo di fronte al senso autentico (...) del suo essere-persona che, dentro i drammi e i rinnegamenti delle persone reali e dentro le traversìe della storia è stato prima obliato dal modo d'esistere dell'uomo moderno, per poi scorrere come fiume carsico nei meandri della travagliata storia della personologia, con un concomitante imporsi, nella forma mentis oggi imperante, della 'dialettica di naturalismo e spiritualismo'. Si offre qui uno studio rigoroso e inedito della filosofia delle persone di Spaemann - miniera ricchissima tutta da scavare -, che prende sul serio la domanda esistenzialmente decisiva sull'enigma della persona, per arrischiare una comprensione della realtà personale che ognuno di noi è, lasciandoci guidare dal 'Socrate tedesco' in un avvincente percorso che raccoglie a piene mani l'eredità e le sfide della tradizione filosofica e restituisce al lettore precisi segnavìa del senso, cioè della vettorialità fondamentale tracciata nell'essere-persona e, resi memori dell'origine e della meta, del senso di marcia a ognuno di noi affidato come compito per divenire le persone uniche che già siamo e sempre più saremo. Alexy si prefigge di individuare quale argomentazione sia razionale (rationaler), ma soprattutto di quali argomentazioni siano inaccettabili poiché del tutto irrazionali: l'autore intende così fornire un criterio di individuazione che possa soddisfare le esigenze del ragionamento giuridico (principalmente quello giudiziario). La ricerca di Alexy non si propone di affermare un giudizio di valore su cosa possa essere considerato effettivamente morale o giuridico e cosa non possa esserlo, vale a dire una particolare decisione, come esito finale del ragionamento, mentre tutto il (...) suo impegno filosofico è diretto verso la definizione delle condizioni metodologiche per la correttezza del ragionamento stesso, allo scopo di scongiurare o, comunque, individuare eventuali irrazionalità. La teoria dell'argomentazione giuridica di Alexy si presenta come un insieme di regole che possono essere considerate una summa ricavata in parte dalla logica formale: accanto a queste rigorose formulazioni, però, si possono osservare anche i contributi della logica induttiva e gli strumenti della retorica, relativi alla verifica delle premesse, come il principio dell'onere dell'argomentazione o del precedente. Le regole individuate da Alexy si dividono essenzialmente in due principali categorie: la prima concernente il discorso pratico generale, la seconda riguarda invece il discorso giuridico, inteso come caso particolare del primo. Nei capitoli seguenti si procede dunque all'analisi di alcuni aspetti della teoria dell'argomentazione, tenendo conto anche delle osservazioni formulate dallo stesso Alexy in risposta alle critiche ricevute, tentando di distinguere i validi contributi della teoria stessa da quegli aspetti che possono apparire eccessivi e inadeguati rispetto alla metodologia adottata. La posizione metodologica debole di Alexy, che mira solo all'esclusione dell'estrema irrazionalità, non risulta poi davvero così “debole” e provoca le critiche di O. Weinberger, J. Habermas, N. MacCormick e J. Raz. L'obiettivo che la teoria di Alexy sembra prefiggersi e mancare, o quanto meno non essere in grado di giustificare adeguatamente il metodo elaborato per conseguirlo, è soprattutto l'elaborazione di una procedura di giustificazione esterna. I severi limiti che lo stesso Alexy pone preliminarmente al proprio progetto vengono infranti, seppure in senso debole, estendendosi al di fuori dell'orizzonte limitato della razionalità relativa al diritto vigente, qualunque esso sia: Alexy non è del tutto fedele alle proposte avanzate con la sua prospettiva debole, in particolare alla netta separazione tra argomentazione e decisione. La neutralità del criterio di controllo di razionalità contrasta, infatti, con qualsiasi pretesa di giustizia, se, come sostenuto da Alexy, deve essere intesa come relativa ad un ordinamento giuridico positivo. Un contributo importante dell'opera di Alexy è la definizione estensiva del concetto stesso di argomentazione elaborata dall'autore che riafferma la complessità e l'apertura del discorso giuridico ben oltre i limiti posti dalle metodologie che ne costringono l'orizzonte entro un rigido logicismo giuridico. Il metodo adottato da Alexy rappresenta un valido contributo anche per lo statuto epistemologico della scienza giuridica, distinguendo l'elaborazione scientifica delle procedure per garantire il controllo di razionalità dalla certezza dei risultati conseguibili. Una volta accettata la sua funzione solo nei suoi limiti storici e politici di strumento di notevole riduzione dell'ambito dell'irrazionalità del discorso giuridico e dei suoi esiti, si può valutare correttamente tutta la portata della teoria, “non definitiva”, elaborata da Alexy e la sua struttura aperta nei confronti di ogni specie di ragionamento giuridico, come prescritto dall'ultima regola di transizione del discorso pratico generale, che espone tutta la teoria dell'argomentazione ad un perenne confronto dialettico con ogni possibile e diversa tesi. A xurisprudencia constitucional española (STC 37/2011, de 28 de marzo, entre outras) ten establecido como fundamento do consentimento informado o dereito á integridade física e moral (art. 15 CE). O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade (...) de autodeterminación positiva esixiría a revisión do seu fundamento constitucional. O presente artigo pretende precisamente revisar a natureza iusfundamental do consentimento informado a partir da obra de W.N. Hohfeld e Robert Alexy. (shrink)

Individuals are a prominent part of the biological world. Although biologists and philosophers of biology draw freely on the concept of an individual in articulating both widely accepted and more controversial claims, there has been little explicit work devoted to the biological notion of an individual itself. How should we think about biological individuals? What are the roles that biological individuals play in processes such as natural selection (are genes and groups also units of selection?), speciation (are species individuals?), and (...) organismic development (do genomes code for organisms)? Much of our discussion here will focus on organisms as a central kind of biological individual, and that discussion will raise broader questions about the nature of the biological world, for example, about its complexity, its organization, and its relation to human thought. In this book, Robert Talisse critically examines the moral and political implications of pluralism, the view that our best moral thinking is indeterminate and that moral conflict is an inescapable feature of the human condition. Through a careful engagement with the work of William James, Isaiah Berlin, John Rawls, and their contemporary followers, Talisse distinguishes two broad types of moral pluralism: metaphysical and epistemic. After arguing that metaphysical pluralism does not offer a compelling account of value and thus cannot (...) ground a viable conception of liberal politics, Talisse proposes and defends a distinctive variety of epistemic pluralism. According to this view, certain value conflicts are at present undecidable rather than intrinsic. Consequently, epistemic pluralism countenances the possibility that further argumentation, enhanced reflection, or the acquisition of more information could yield rational resolutions to the kinds of value conflicts that metaphysical pluralists deem irresolvable as such. Talisse’s epistemic pluralism hence prescribes a politics in which deep value conflicts are to be addressed by ongoing argumentation and free engagement among citizens; the epistemic pluralist thus sees liberal democracy is the proper political response to ongoing moral disagreement. Medical ethics changed dramatically in the past 30 years because physicians and humanists actively engaged each other in discussions that sometimes led to confrontation and controversy, but usually have improved the quality of medical decision-making. Before then medical ethics had been isolated for almost two centuries from the larger philosophical, social, and religious controversies of the time. There was, however, an earlier period where leaders in medicine and in the humanities worked closely together and both fields were richer for it. (...) This volume begins with the 18th century Scottish Enlightenment when professors of medicine such as John Gregory, Edward Percival, and the American, Benjamin Rush, were close friends of philosophers like David Hume, Adam Smith, and Thomas Reid. They continually exchanged views on matters of ethics with each other in print, at meetings of elite intellectual groups, and at the dinner table. Then something happened, physicians and humanists quit talking with each other. In searching for the causes of the collapse, this book identifies shifts in the social class of physicians, developments in medical science, and changes in the patterns of medical education. Only in the past three decades has the dialogue resumed as physicians turned to humanists for help just when humanists wanted their work to be relevant to real-life social problems. Again, the book asks why, finding answers in the shift from acute to chronic disease as the dominant pattern of illness, the social rights revolution of the 1960's, and the increasing dissonance between physician ethics and ethics outside medicine. The book tells the critical story of how the breakdown in communication between physicians and humanists occurred and how it was repaired when new developments in medicine together with a social revolution forced the leaders of these two fields to resume their dialogue. Una terza collezione, preparata per i Collected Works of Bernard Lonergan dai curatori Robert M. Doran e John D. Dadosky, è un utile complemento ai volumi quattro e tredici della serie. Il volume contiene quindici scritti, redatti tra il 1974 e il 1982, e include alcuni dei suoi più importanti scritti brevi, come "Prolegomeni allo studio della coscienza religiosa emergente del nostro tempo" e "Diritto naturale e mentalità storica", di cui sono specificate le voci d'archivio, in modo che il (...) lettore possa consultarle. Gli interventi di questo volume ripropongono in chiave nuova i temi di una vita. Senza ritornare in alcun modo sulle principali enfasi dei primi lavori di Lonergan - la teoria cognitiva e poi l'esplorazione di un quarto livello esistenziale di coscienza - si concentrano maggiormente sull'amore e sul movimento dall'alto verso il basso della coscienza. Robert Zafft presents the too-often abstract language of business ethics in straight-forward language, laying out two themes commonly ignored: in the real world, it is often easy to lay out an ethical path but often very difficult to implement and encourage adherence to that path, and reputation is the single most important asset in business.

The idea to produce the current volume was conceived by Jiirgen Mittelstrass and Robert E. Butts in 1978. Idealist philosophers are wrong about one thing: the temporal gap separating idea and reality can be very long indeed - even ten or so years! Problems of timing were joined by personal problems and by the pressure of other professional commitments. Fortunately, James Brown agreed to cooperate in the editing of the volume; the infusion of his usual energy, good judgement and (...) good-natured promptness saved the volume and made its produc tion possible. Despite the delays, the messages of the papers included in the book have not gone stale. An extremely worthwhile exercise in international philosophical cooperation has come to fruition; the German constructivist philosophical position is here represented in papers in English that will make its contemporary importance available to a larger audience. The editors owe thanks to many persons. All involved in the project owe much to the interest and support of Nicholas Rescher, a friend of the undertaking from the time of its inception. My review of the translations was helped immensely by Andrea Purvis' careful copy editing of the typescript. We compare Gödel’s and Brouwer’s explorations of mysticism and its relation to mathematics.

In this introductory paper, we assess the current status of blindsight -- the phenomenon in which patients with damage to their primary visual cortex retain the ability to detect, discriminate and localize visual stimuli presented in areas of their visual field in which they report that they are subjectively blind. Blindsight has garnered a great deal of interest and critical research, in part because of its important implications for the philosophy of mind. We briefly consider why this is so, and (...) then go on to examine three empirical questions which have fuelled challenges to the validity of blindsight as a distinct neuropsychological phenomenon. First, is blindsight simply degraded normal vision? Second, does blindsight depend on undamaged areas of primary visual cortex? Third, does evidence that blindsight patients are aware of moving stimuli undermine the apparent dissociation between access to visual information and visual experience in blindsight? In the course of the review we introduce the four other papers on blindsight in this issue. We conclude that, although patients with primary visual cortex damage may indeed perceive moving stimuli, there is still good evidence for a dissociation between access to information and phenomenal experience which cannot be accounted for in terms of degraded normal vision or undamaged primary visual cortex. René Descartes was a French mathematician and philosopher and is considered the father of modern philosophy. Coinciding with a period of scientific exploration and discovery in Europe, modern philosophy emphasized the use of reason over a dependence on traditional ways of thinking about the world. Embodying this spirit, Descartes split with many of the medieval and scholastic philosophers that came before him and attempted to build a philosophical system from scratch. In his Meditations on First Philosophy, Descartes begins this project (...) by considering how much we can know about the world around us. In this piece, we will critically examine Descartes’ arguments that reality is not what it appears to be. Descartes makes the case that we can't rule out that our life is all a dream or that we might all be radically deceived. Is there any way that we can rule these things out? (shrink)

The first edition of this book was published in 1977. At that time the field of thanatology, the study of death and dying, was still reasonably new and was dominated by research done by psychiatrists and social scientists. The most notable person in the field at the time was Elisabeth Kubler-Ross, who was widely credited with having brought thanatology into public view with the 1969 publication of her book On Death and Dying. Two research centers on death and dying were (...) gaining national reputations: The Foundation of Thanatology in New York (Austin Kutscher, director), and the Center for Death Education and Research (Robert Fulton, director) at the University of Minnesota. Bender, Robert Review of: In the public interest: 150 years of the Victorian Auditor-General's office, by Peter Yule, 2002, VAGO, 304 pages.

This article traces the evolution by which in the context of 1930s South Africa the liberal philosopher Alfred Hoernlé came to recognize the inability of classical liberalism to address the problems of a society in which a racial hierarchy had become deeply entrenched. Although he must be criticized for his patriarchal approach and for the pessimism that led him to take White attitudes toward Black South Africans as an unchangeable part of the situation that simply had to be accepted, his (...) insight into the limits of liberalism still resonates. While most White commentators were still thinking of racism in terms of beliefs and attitudes, he already understood that the problem lay in the systemic adoption of “techniques of domination” or what we today might call institutional racism. Although his proposal in 1939 that “Total Separation” was “a legitimate application of sound liberal ideas” was deeply problematic in context and might well have had a serious negative impact, it should be understood that it was intended to highlight the fundamental paradox into which liberalism fell when attempting to solve the problems it had helped to create by its belief in a civilizing mission that began with violence.
